Terms of Service

These Terms of Service (“Terms”) govern your use of crimsonmoments.com and any photography or videography services booked with Crimson Concepts Media (“we,” “us,” “our”). By submitting an enquiry, signing a booking agreement, or engaging our services, you (“Client,” “you”) agree to these Terms. If anything in your signed booking agreement or invoice conflicts with this page, the signed agreement governs.

1. Our Services

Crimson Concepts Media provides wedding, portrait, corporate, maternity, and event photography and videography services, as described on our Site and in your specific booking agreement or quote. Final scope, pricing, and deliverables for your session are confirmed in a written agreement or invoice, which takes precedence over general package descriptions on the Site.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to book our services. By making a booking or paying a retainer, you confirm that you meet this requirement.

3. Booking & Payment

• A 40% non-refundable retainer is required to secure your booking date. Dates are not confirmed until this payment is received.
• The full balance must be settled at least 48 hours before your event date (or before your session, for non-event bookings).
• Failure to complete payment by the agreed deadline may result in penalties, delayed coverage, or cancellation at our discretion.
• We accept mobile money (MTN MoMo), bank transfer (Stanbic and Ecobank), and cash. All prices on our Site are listed in Ghana Cedis (GH₵), inclusive of VAT and other applicable taxes, and are starting points; final quotes depend on date, location, guest count, and specific requirements.

4. Cancellations & Rescheduling

• Retainers are non-refundable, as they compensate us for reserving your date and turning away other clients.
• If you need to reschedule, your retainer is transferable to a new date within 12 months, subject to our availability. If the new date falls into a period with different pricing, the price in effect at the time of the change will apply.
• Cancellations should be made in writing (email or WhatsApp is fine) as soon as you know.

5. Force Majeure

Occasionally, circumstances entirely outside our reasonable control — illness, accident, death, natural disaster, civil unrest, or similar events — may affect our ability to perform some or all of our services. In that case:

• We will notify you as soon as reasonably possible. Notice is only considered adequate if given at least 14 days before your wedding or major event date; for sessions booked with less lead time than that, we will give as much advance notice as reasonably possible under the circumstances.
• Where adequate notice is given, we will make every reasonable effort to arrange a trusted replacement photographer or videographer of comparable style, in consultation with you.
• If we cannot arrange a suitable replacement, or if notice was not adequate under the standard above, you are entitled to a full refund of any payment made for services not rendered.
• Delays or interruptions occurring during a session that are outside our control (e.g., venue restrictions, weather, third-party vendor delays) do not, on their own, constitute non-performance, provided we have made reasonable efforts to deliver the agreed coverage. See Section 14 (Refunds & Non-Performance).

6. Coverage Structure & Time Policy

All collections operate on defined hourly coverage.

• Coverage begins at the contracted start time, regardless of event delays.
• Unused hours are not refundable or transferable.
• Coverage exceeding contracted hours requires written authorization on the day (a text or WhatsApp message is sufficient; verbal agreement alone is not).
• Overtime is billed at GH₵1,000 per hour. If overtime is declined, coverage concludes at the agreed end time.
• If celebrations extend significantly beyond the agreed event flow, additional coverage may be accommodated subject to team availability, and will be billed as overtime at the applicable rate, communicated transparently and confirmed in writing.

7. Client Cooperation

To help us deliver the coverage you’re hoping for, you agree to:

• Identify key people, moments, and traditions ahead of time
• Allow adequate time for portraits and creative direction
• Assign a representative to guide our team to important scenes or individuals

Crimson Concepts is not responsible for missed moments resulting from late starts, cultural delays, vendor inefficiencies, restricted access, or a lack of the cooperation described above.

8. Multi-Day Weddings & Pre-Wedding Sessions

• For weddings held across multiple days, clients are required to allocate coverage across each day or event within their selected collection. Excluding any session, ceremony, or event does not affect the overall collection fee.
• Where included or offered as a complimentary experience, pre-wedding sessions require a minimum of 15 working days’ notice prior to the wedding date. Sessions not completed within this timeframe are forfeited and cannot be exchanged or refunded.

9. Delivery Timeline

• A curated preview of 20 images will be shared within 5–10 working days after your event.
• Final photographs and films will be delivered within 30–50 working days. Extensions may be discussed with you during busy seasons.
• Printed products, including photobooks, are produced by external vendors and may follow separate timelines.
• “Working days” means Monday–Friday, excluding Ghanaian public holidays.

10. Travel & Logistics

Events outside Greater Accra or its outskirts may require the client to provide transportation, meals, and accommodation for our team to ensure efficient coverage. This will be discussed and confirmed as part of your quote.

11. Image Usage & Copyright

Crimson Concepts Media retains copyright ownership of all images and footage we produce. When you book with us, you and your directly affiliated vendors (e.g., your wedding planner, printer, or album maker) receive a broad license to use your delivered images for personal, non-commercial purposes — including printing, sharing, social media, and fulfilling your own order.

• Commercial use (e.g., advertising, resale, or use by a business other than in fulfilling your own order) is not included and requires separate written permission from us.
• By default, we also retain the right to use images and footage from your session in our own marketing — on our website, portfolio, Instagram, and other promotional materials, as described in our Privacy Policy.
• If you would prefer we not publish your images on our own website, portfolio, or social media, this can be arranged for an additional fee.
• Full exclusivity (restricting all other usage, including our own) is available upon payment of a separate exclusivity fee.
• We do not typically provide raw/unedited files, as editing is part of our creative process; this can be discussed for an additional fee for specific commercial needs.

12. Minors in Photographs

Our sessions frequently include children — at weddings, family and maternity sessions, and events. Booking a session with us as a parent or guardian constitutes your consent for your own minor children to be photographed and filmed as part of that session. Where a minor who is not your own child appears in coverage (for example, another family’s children at a wedding), we rely on the event host or that child’s own parent or guardian for consent, both to be photographed and for any public use of those images. 13. Quality Concerns & Delivery Disputes

Please review your delivered gallery promptly. Any concerns about image quality, missing content, or delivery errors should be raised with us in writing within 14 days of delivery. We will work with you in good faith to resolve legitimate concerns raised within this window.

14. Refunds & Non-Performance

Refunds are available if we fail to appear on the event date without adequate prior notice, as defined in Section 5 (Force Majeure). Delays or interruptions caused by factors beyond our control, as described in Section 5, do not constitute non-performance on their own and are not automatically grounds for a refund.

15. Limitation of Liability

While we take every precaution (backup equipment, backup files, experienced teams), photography and videography carry inherent risk of technical failure or unforeseen circumstances. Our liability in any such case is limited as described in Section 14. We are not liable for indirect, incidental, or consequential damages.

We strongly recommend clients do not rely solely on our coverage for once-in-a-lifetime moments without a backup plan where feasible (e.g., a trusted friend with a phone camera for key moments).

16. Indemnification

You agree to indemnify and hold Crimson Concepts Media harmless from claims, damages, or losses arising from your breach of these Terms, your negligence, or the actions of your guests or invitees during a session or event we are covering, except where such claims arise from our own negligence or wilful misconduct.

17. Personnel & Substitution

We make every effort to fulfil your booking with the specific photographer(s) or videographer(s) discussed at booking. In the rare event that a team member becomes unavailable due to illness or unforeseen circumstances, we reserve the right to substitute a team member of comparable skill and style, and will inform you as soon as possible.

18. Governing Law & Venue

These Terms are governed by the laws of the Republic of Ghana. Any disputes will first be addressed through good-faith discussion. If unresolved, disputes will be subject to the exclusive jurisdiction of the courts of Accra, Ghana.

19. Severability

If any provision of these Terms is found by a court to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

20. Entire Agreement & Notices

These Terms, together with your signed booking agreement or invoice, constitute the entire agreement between you and Crimson Concepts Media regarding your session, superseding any prior discussions. Formal notices under these Terms may be given by email or WhatsApp to the contact details either party has provided.

21. Changes to These Terms

We may update these Terms from time to time; the “Last updated” date reflects the latest revision. For existing bookings, the Terms in effect at the time of your signed agreement will apply.
